Terms of Service

By accessing or using the Rivaa health performance platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you ("User" or "you") and Sixth Sense Enterprises OPC Pvt Ltd ("Company," "we," "us," or "our").

Rivaa is an AI-powered health performance platform that provides the following features:

Activity & Fitness Tracking

Log and monitor workout sessions, strength training, heart rate zones, RPE, calorie burn, and duration metrics through WhatsApp or the web app.

Nutrition Logging

AI-powered meal analysis with full macro and micronutrient tracking via natural language messages on WhatsApp.

Health & Vitals Monitoring

Log and track blood pressure, glucose levels, body weight, lab results, and other health vitals in one unified profile.

3D Body Composition Analysis

Upload a photo to generate a 3D body mesh with 20+ circumference measurements, body fat percentage, lean mass, BMI, and wellness statistics.

Habit Tracking

Build and maintain daily habits with streaks, reminders, and progress visualisation.

AI Data Query

Ask natural language questions about your health data and receive instant AI-powered answers via WhatsApp or the web platform.

Trainer & Caretaker Access

Allow trainers or caretakers to view your health data in real time through an invite-based relationship system.

To access the Service, you must create an account and provide accurate, complete registration information including your name, email address, and phone number. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify us immediately of any unauthorised use of your account. We reserve the right to suspend or terminate accounts that provide inaccurate information or violate these Terms.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:

Prohibited Activities

Upload photos or data that belong to other individuals without their explicit consent. Share your account credentials with unauthorised parties or attempt to circumvent usage limitations or security measures. Use the Service to process or store data in violation of applicable privacy laws. Attempt to reverse engineer, decompile, or extract the underlying algorithms or AI models powering the Service. Use the Service in any manner that could damage, disable, overburden, or impair our servers or networks. Submit false health data with the intent to manipulate AI outputs or mislead trainers or caretakers.

Your Health Data

You retain ownership of all health data, photos, and information you submit to the Service. By submitting data, you grant us a limited, non-exclusive licence to process and analyse your data using our AI systems for the sole purpose of providing the requested services.

AI-Generated Outputs

Body composition metrics, nutrition analyses, health insights, and AI query responses are generated through automated AI processing. These outputs are provided for informational purposes only and do not constitute medical advice. Always consult a qualified healthcare professional before making health or medical decisions based on Service outputs.

Third-Party AI Providers

Our Service utilises third-party AI APIs to process your data, including for body scan analysis and WhatsApp AI interactions. By using our Service, you acknowledge and consent to this processing in accordance with those providers' terms.

When you accept an invite from a trainer or caretaker, you grant them access to view your health data as defined by their role. Trainers can view your activity, nutrition, body scans, and health vitals. Caretakers can view your health logs and vitals.

You may revoke this access at any time through the platform settings. You are solely responsible for the relationships you establish on the platform and should only accept invites from individuals you trust.

Free Plan

The Free plan provides access to core features including activity, nutrition, and health tracking, 3 body analysis scans, and 3 AI data queries at no cost. No payment information is required.

Pro Plan

The Pro plan provides unlimited body analysis scans, unlimited AI data queries, and advanced analytics for a monthly or annual subscription fee. Pricing is displayed at checkout and on the pricing page.

Cancellation

You may cancel your Pro subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods unless required by applicable law.

We strive to maintain high service availability but do not guarantee uninterrupted access to the Service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control, including third-party AI API availability or WhatsApp Business API limitations.

Health metrics and AI-generated insights are based on the data you provide and algorithmic analysis. These outputs should not replace professional medical advice and should be validated in your specific health context.

The Service is provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, our total liability for any claims arising from or related to the Service shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, health outcomes based on Service outputs, or business opportunities.

You are responsible for the accuracy and completeness of the health data you submit to the Service. AI-generated health insights and body composition metrics are dependent on the quality of the data and photos you provide.

Rivaa is not a medical device and does not provide medical diagnoses or treatment recommendations. You acknowledge that Service outputs are for personal health awareness purposes only and should not replace the advice of qualified healthcare professionals.

You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

We may terminate or suspend your access to the Service at any time, with or without cause, including if you violate these Terms. Upon termination, your right to use the Service will cease immediately and your account data may be deleted.

You may delete your account at any time through the account settings or by contacting our support team at info@rivaa.ai.

We reserve the right to modify these Terms at any time. We will notify users of material changes through the Service or via email. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 2015 of India, with proceedings conducted in New Delhi, India.

Severability

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms constitute the entire agreement between you and the Company regarding the Service and supersede all prior agreements and understandings.

Force Majeure

We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including acts of God, government actions, or third-party service interruptions.
